Acceptance of Terms
By completing an enrolment form, making a payment, or accessing any part of the Service, you confirm that you have read, understood, and agreed to be bound by this Agreement.
You must be at least 18 years of age to enrol in any Kernel Atlas course or programme. By agreeing to these terms, you confirm that you meet this age requirement and have the legal capacity to enter into a binding agreement under Malaysian law.
If you are enrolling on behalf of an organisation, you represent that you have the authority to bind that organisation to this Agreement.
03
Service Description
Kernel Atlas offers structured online courses and cohort-based programmes in AI engineering and related technical subjects. Current offerings include Python for AI Foundations (8 weeks), the AI Engineering Intermediate Track (10 weeks), and the Cohort-Based Yearlong Programme (12 months).
Course content is delivered online through a combination of recorded lectures, practice notebooks, and scheduled live sessions. The Yearlong Programme additionally includes in-person sessions held in Kuala Lumpur.
We make reasonable efforts to maintain Service availability. Scheduled maintenance, platform updates, or circumstances beyond our control may occasionally affect access. We will endeavour to give notice of planned downtime where practicable.
The Service is offered primarily to participants in Malaysia. Access from outside Malaysia is not restricted, but local laws or internet policies in the participant's country of access remain the participant's responsibility.
04
User Accounts
Enrolment requires the creation of a participant account using a valid email address. You are responsible for keeping your account credentials confidential and for all activity that takes place under your account.
You agree to provide accurate and current information during registration and to update it promptly if it changes. Providing false information may result in immediate termination of your enrolment.
We reserve the right to suspend or terminate an account where there is reasonable suspicion of misuse, where fees remain unpaid, or where a participant has materially breached these terms.
05
User Responsibilities
As a participant in the Service, you agree to use the platform and Content for personal study purposes only. Specifically, you agree:
- to engage with course materials respectfully and in good faith;
- not to share, reproduce, redistribute, or resell any Content without our prior written permission;
- not to use the Service in any manner that disrupts other participants or our staff;
- not to attempt to gain unauthorised access to any part of the Service or its underlying systems;
- not to submit work that is not your own in any practice notebook or project assessment;
- not to use course materials to develop competing educational products or services.
Breaches of these responsibilities may result in removal from the course or programme without refund.
06
Intellectual Property
All Content, course structures, practice notebooks, lecture materials, and other educational resources made available through the Service are the intellectual property of Kernel Atlas or our licensors. These are protected under Malaysian copyright law and, where applicable, international intellectual property conventions.
Upon payment and enrolment, we grant you a limited, personal, non-exclusive, non-transferable licence to access and use the Content for your own study purposes during the course period. This licence does not permit you to copy, share, sublicence, or otherwise distribute the Content.
Work you produce independently in your practice notebooks remains your own. By submitting notebooks for completion review, you grant Kernel Atlas a non-exclusive right to review that work for the purpose of issuing a completion record. We will not publish or distribute your submitted work without your permission.
07
Payment Terms
Course fees are stated in Malaysian Ringgit (MYR). Current fees are: Python for AI Foundations — RM 480; AI Engineering Intermediate Track — RM 1,460; Cohort-Based Yearlong Programme — RM 2,920. Fees are inclusive of all course materials and session access unless otherwise stated.
Payment is due in full at the time of enrolment unless an instalment arrangement has been agreed in writing with Kernel Atlas prior to registration. Enrolment is confirmed only upon receipt of payment.
Refund Policy: Requests for a refund submitted more than 7 days before the course start date will receive a full refund less any payment processing fees. Requests submitted within 7 days of the course start date are not eligible for a refund. Once a course has commenced, no refund will be issued except at our sole discretion in exceptional circumstances.
We reserve the right to adjust course fees for future intake cohorts. Changes will not affect enrolments already confirmed and paid.
08
Enrolment & Completion
Enrolment in a course or programme is personal and non-transferable. You may not transfer your enrolment to another person.
A course completion record is issued to participants who submit all required practice notebooks within the course period. Completion records reflect participation in an educational programme; they are records of study, not professional qualifications or regulated credentials.
For the Yearlong Programme, a completion record is issued upon submission of the capstone project. Participants who do not submit the capstone by the end of the programme period will not receive a completion record for that programme, though records for any paired courses completed within the year remain valid.
Academic integrity is expected. Submitting work that is not your own, or that has been generated by AI tools without meaningful original contribution, is a breach of these terms and may result in removal from the programme.
09
Disclaimers
The Service and all Content are provided on an "as is" and "as available" basis. To the extent permitted by Malaysian law, Kernel Atlas makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of the Content.
Participation in our courses does not guarantee employment, career advancement, or any specific technical outcome. Learning outcomes depend on the effort, background, and consistency that each participant brings to their study.
Course Content reflects the knowledge and perspective of our instructors at the time of preparation. The AI engineering field moves quickly; some technical details may become dated. We update materials on a reasonable schedule but do not warrant that all Content is current at any given time.
10
Limitation of Liability
To the fullest extent permitted under the laws of Malaysia, Kernel Atlas shall not be liable for any indirect, incidental, special, or consequential losses arising from your use of or inability to use the Service, including but not limited to loss of data, loss of business opportunity, or loss of anticipated study outcomes.
Our total aggregate liability to you for any claim arising from or related to this Agreement shall not exceed the course fee paid by you for the relevant course or programme.
Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud, or for any liability that cannot be excluded by law.
11
Indemnification
You agree to indemnify and hold harmless Kernel Atlas, its instructors, staff, and partners from and against any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of the Service, or any content you submit that infringes the rights of a third party.
12
Termination
You may withdraw from a course at any time. Refund eligibility is governed by the Payment Terms in Section 7.
We may terminate your access to the Service with immediate effect if you breach these terms materially and, where the breach is capable of remedy, fail to remedy it within 7 days of written notice from us.
Upon termination, your licence to access Content ends. Sections 6 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Dispute Resolution) survive termination.
13
Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia, including the Contracts Act 1950 and the Consumer Protection Act 1999 where applicable.
If a dispute arises, we encourage you to contact us first at [email protected] so that we can attempt to resolve the matter informally. We will endeavour to respond within 10 business days.
If informal resolution is not achieved within 30 days of your written notice of dispute, either party may refer the matter to mediation under the Asian International Arbitration Centre (AIAC) Mediation Rules before commencing litigation.
The courts of Malaysia, sitting in Kuala Lumpur, shall have exclusive jurisdiction over any dispute that proceeds to litigation under this Agreement.
14
General Provisions
Entire Agreement. This Agreement constitutes the entire agreement between you and Kernel Atlas regarding the Service and supersedes any prior discussions, representations, or agreements.
Severability. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
Waiver. Our failure to enforce any provision of this Agreement at any time does not constitute a waiver of that provision or of our right to enforce it in the future.
Assignment. You may not assign or transfer your rights or obligations under this Agreement without our prior written consent. We may assign our rights to a successor entity in the event of a business restructure or acquisition.
Notices. Notices from Kernel Atlas to you will be sent to the email address on your account. Notices from you to us should be sent to [email protected].
15
Changes to Terms
We may update these Terms and Conditions from time to time. When we do, we will revise the Last Updated date at the top of this page and, for material changes, notify enrolled participants by email at least 14 days before the changes take effect.
Continued use of the Service after the effective date of updated terms constitutes your acceptance of those changes. If you do not agree with updated terms, you should discontinue use of the Service and contact us to discuss your enrolment options.
